Terms and conditions for live webinars

"We", "us" and "our" means Nozick Consulting Limited. "You" and "your" means the person or organisation buying a ticket from us.

2. What these terms cover

These terms apply only to tickets for our live webinars.

Our other products and services have separate terms:

If you buy more than one thing from us, more than one set of terms applies alongside each other — always the terms for the product concerned. An overview of all our terms is at nozickconsulting.com/conditions.

By ordering a ticket you accept these terms. They can be viewed and downloaded on the website at the moment you order.

3. What a ticket gives you

A live webinar is an online seminar that takes place live at a pre-announced date and time, with a presentation and a question-and-answer section.

With a ticket you get:

  • a personal joining link, which you receive by email;
  • the option to submit questions in advance, up to 24 hours before the start;
  • any additional materials (such as the slides), if that is stated on the webinar page for the webinar concerned.

3.1 One ticket, one participant

A ticket gives access for one person. The joining link is personal.

Permitted: watching together with members of your own household from the same screen, as long as the link itself is not passed on further.

Not permitted: sharing the link with colleagues, business contacts or anyone else outside your household. Would several people from your organisation like to attend? Get in touch — we are happy to make separate arrangements.

3.2 Questions in advance

You can submit questions up to 24 hours before the start. Questions received in time are given priority. We cannot guarantee that every question submitted will be covered: time is limited and we select the questions that are relevant to the largest number of participants. Questions that are very specific to one personal situation are better suited to an advisory meeting than to a webinar.

3.3 The recording is a separate product

A ticket for the live webinar does not give you a right to the recording. For most webinars we later offer a recording as a separate, paid product, with its own price and its own terms.

If it is expressly stated for a particular webinar that the recording is included with the ticket, then of course that applies.

We are not obliged to make or offer a recording of every webinar.

3.4 Language

Our webinars are given in Dutch, even if you are viewing the website in English and even if your order process and emails are in English. If it is expressly stated for a particular webinar that it is in English, then that applies. In all other cases you should assume Dutch. Buying a ticket when you do not understand Dutch is not a ground for a refund.

4. How an order is concluded

  1. You choose a webinar and go to the payment page.
  2. You fill in your details, and your company details if you are buying on behalf of a business.
  3. You pay. Participation is only possible after payment in full and in advance.
  4. You receive a confirmation by email. At that moment the agreement is concluded.

No confirmation within 1 hour? Get in touch.

We may refuse or reverse an order in the case of an obvious error (for example a price that is clearly wrong due to a technical fault) or where we suspect misuse or fraud. If you have already paid, you will get your money back.

5. Prices and pricing tiers

All prices are in euros.

All prices quoted are total prices: you pay the amount shown on the website, with no VAT added at checkout.

Live webinars use pricing tiers. For many webinars the following apply in sequence:

  1. a super early bird price;
  2. an early bird price;
  3. the regular price.

The price you pay is the price that applies at the moment you order. The current price and the date on which a tier ends are stated on the webinar page.

  • If you order after a tier has expired, the price then current applies. There is no right to the earlier, lower price retrospectively.
  • If a price later drops, or a promotion is run, that does not give a right to a refund of the difference on an order that has already been completed.

6. VAT

We sell from Malta. The VAT we charge depends on where you are and whether you are buying as a private individual or as a business:

You are in the EU, buying as a business, and have a valid, verified EU VAT number Reverse charge — 0%; you account for the VAT yourself in your own country

For the reverse charge we check your VAT number through VIES, the European Union's official verification system. We only apply the reverse charge if that check succeeds. If verification fails, we treat the sale as an ordinary consumer sale and charge the VAT rate of your country. You are welcome to try again with a correct number or to get in touch.

You are responsible for the accuracy of the details you provide (country, capacity, VAT number). If incorrect details mean we charge too little VAT, we may charge you the difference afterwards.

7. Payment and invoice

You pay at the time of ordering, by credit card, debit card or iDEAL. Payment is processed by Stripe, our payment service provider; we do not receive or store full card details ourselves.

You receive an invoice from Nozick Consulting Limited, in euros, by email. If something on your invoice is wrong (for example an incorrect company name or a missing VAT number), let us know within 30 days and we will correct it.

If a payment is reversed or charged back, we may block your participation until payment has been settled.

8. Participation, cancellation and rescheduling

8.1 Your joining link

Your joining link arrives by email. Check your email address carefully when ordering — a typo there is by far the most common reason a link does not arrive. Nothing received? Check your spam folder, and otherwise get in touch and we will resend the link.

Please check before the webinar that you are able to take part (connection, device, any firewall at your employer).

8.2 If you cancel

You can cancel your participation free of charge up to 24 hours before the start of the webinar. You will then receive a full refund.

If you cancel within 24 hours of the start, or you are absent without notice, there is no right to a refund.

This is separate from your statutory cooling-off period as a consumer — see chapter 9. You may always rely on whichever arrangement is more favourable to you.

8.3 Transferring your ticket

Can't make it yourself, but would like a colleague or business contact to attend in your place? That is possible: let us know at least 48 hours before the start, with the name and email address of the substitute, and we will transfer the ticket. Transfer is free of charge and possible once per ticket.

Transferring to another date or another webinar is not a right, but you are always welcome to ask — get in touch and we will see what is possible.

Reselling tickets to third parties is not permitted.

8.4 If we reschedule or cancel

We may reschedule or cancel a webinar, for example if the speaker is ill, in the event of a technical failure, or in other circumstances beyond our control.

  • Rescheduled to a new date: your ticket remains valid. Can't make the new date? On request you will receive a full refund, or — if a recording is made — access to that recording. Your choice.
  • Cancelled with no new date: you receive a full refund.

If something goes wrong on our side during the webinar, such that the webinar does not take place or largely does not take place, we will find a suitable solution together: attending a future edition, the recording, or a refund.

If the problem is on your side (your internet connection, your device, a firewall at your employer), we are unfortunately unable to refund.

8.5 Conduct during the webinar

We expect you to behave respectfully in the chat and during the Q&A. Spamming, abuse or disrupting the progress of the webinar is not permitted. If you breach this, we may deny you further access to that webinar, without a refund.

9. Right of withdrawal (cooling-off period)

9.1 If you are a consumer

If you are buying as a consumer — that is, not in the course of a trade or profession — you have, in principle, a 14-day cooling-off period for a distance purchase, during which you may withdraw without giving a reason.

For a live webinar ticket the following applies: your cooling-off period ends at the moment the webinar begins. So if the webinar takes place within 14 days of your order, your cooling-off period runs until the webinar starts.

If you withdraw in time, you receive a full refund.

In practice, our own cancellation arrangement (chapter 8.2: free cancellation up to 24 hours before the start) is more generous than the statutory cooling-off period for most people. You may always rely on whichever arrangement works out best for you.

9.2 If you are buying as a business

If you are buying in the course of a trade or profession, you have no statutory right of withdrawal. Our own cancellation arrangement in chapter 8.2 does still apply to you.

9.3 How to withdraw

Let us know via our contact form or by email to contact@nozickconsulting.com, with your name, your order and a statement that you are withdrawing. An informal email is enough — you do not need to use a form and you do not need to give a reason. We will confirm receipt.

9.4 Refunds

If you withdraw in time, we refund the full amount including VAT within 14 days of receiving your withdrawal, using the same payment method you used to pay, unless we agree otherwise. We do not charge any fee for a refund.

10. Discount codes

You can use one discount code per order. Discounts are never stacked: if you qualify for a discount in more than one way, we automatically apply the one that is most favourable to you.

A code may be tied to a particular webinar, a particular period, a maximum number of uses, or to you personally. What applies is stated with the code itself.

Discount codes cannot be exchanged for cash and do not apply retrospectively to an order that has already been completed. If a code is demonstrably misused (for example resold or shared on a large scale), we may withdraw it.

11. Intellectual property and use

The webinar, the presentation, the slides and all associated material are and remain our intellectual property (or that of our licensors).

What you may do: take part and watch for your own use, take notes, and use what you have learned to understand your own situation and discuss it with your own adviser. If you receive the slides, you may keep and print them for your own use.

What you may not do:

  • record the webinar in whole or in part, in image or sound;
  • share your joining link with anyone outside your household, or publish it;
  • copy, forward, distribute, upload or make public any material;
  • resell the content or exploit it commercially, or use it as teaching material, in your own services or in your own publications, without our prior written consent.

In the event of a serious or repeated breach we may block your access immediately, without a refund, and recover our losses from you.

12. Liability

12.1 A webinar is general information, not personal advice

Our webinars are general, informative content. They are not tailored to your personal situation and do not constitute tax, legal or financial advice. Taking part does not create an advisory relationship between you and us.

Tax rules are complex, differ from country to country, change regularly and work out differently depending on the precise facts. What is discussed in a webinar may be different in your situation. An answer to your question during the Q&A is also a general answer based on limited information — not tailored advice.

So do not take any decision with financial or tax consequences — such as emigrating, restructuring a business or moving assets — on the basis of a webinar alone. Have your situation assessed personally first, either with us through an advisory meeting (under the separate advisory terms) or with another adviser.

We give no guarantee whatsoever as to any specific results or outcomes following a webinar.

12.2 Limitation of our liability

To the extent permitted by law:

  • we are not liable for decisions you take on the basis of a webinar, or for consequential loss, lost profits, missed savings or additional tax assessments arising from them;
  • our liability is in any event limited to the amount you paid for the ticket;
  • we are not liable for faults in your internet connection or equipment, for faults at third parties on which performance depends (such as the video service or the payment service provider), or for force majeure.

These limitations expressly do not apply in the case of intent or deliberate recklessness on our part, in the case of death or personal injury, and not to the extent that mandatory consumer law does not permit them. If you are a consumer, your mandatory statutory rights remain unaffected.

13. Personal data

For your participation we process personal data: your name and email address, your payment and invoicing details, your company details and VAT number if you are buying as a business, and the questions you submit in advance.

We use those details to give you access, send you your invoice, keep you informed about the webinar you have bought, and to comply with our statutory (administrative and tax) obligations. In doing so we use service providers, including our payment service provider, email service, video service and our accounting and client administration.

We do not sell your data and do not provide it to third parties for their own purposes.

You only receive our newsletter if you have signed up for it; you can unsubscribe at any time using the link at the bottom of every newsletter.

14. Complaints, applicable law and disputes

14.1 Complaints

Do you have a complaint? Please tell us first via our contact form. We will respond substantively within 14 days. The vast majority of issues can be resolved that way.

14.2 Applicable law

Maltese law applies to these terms and to any agreement governed by them.

If you are a consumer, the following also applies, and it matters: this choice of law may not deprive you of the protection of the mandatory rules of the country where you live. If you live in the Netherlands, for example, mandatory Dutch consumer protection continues to apply to you even though Maltese law has been chosen.

14.3 Competent court

Disputes are submitted to the competent court in Malta.

Here too there is an exception for consumers: if you are a consumer, under European law you may always bring proceedings before the court of the country where you live, and we may in principle only bring proceedings against you there. We cannot take that protection away from you in these terms, and we are not attempting to.
